During his visit in Indonesia, Prof. Fezer Tamas spend a lot of time to teach at Faculty of Law, Islamic University of Indonesia. Last time, he invited to gave public lecture at Postgraduate Study, Faculty of Law, Islamic University of Indonesia on Saturday, 18 January 2014. Most participants were come from students of Postgraduate Program Faculty of Law Islamic University of Indonesia and also its lecturers

“Master and Doctoral students were invited to come in that Public Lecture in order to get more knowledge about Hungarian culture, education, and legal system. Because of Hungarian becomes one of the member of European Union thus this country has significant changes on law synchronizing the regulation in European Union.” said Dodik Setiawan Nur Heriyanto, SH, MH, Head of International Relations Committee during the interview with the mass media.”The existence of European Union implicates the harmonization of every European matters. The most of lawyer in EU interest to discuss and faces with the European Court of Justice. This ECJ stablished in order to judge the different interpretation and application of EU Legislation. One case recently become judged by ECJ was the interpretation of the legislation text regarding the cancelation of flight. The judge interpret that it is mandatory obligation for the airline to give compensation in the case of cancelation but not for the delayed flight.” said Prof. Fezer Tamas.

“There are four freedoms in EU communities such as freedom of goods, services, capital, and people and business. It means that no borders between the movement of that four things in each member of EU. Different if Hungarian person want to move to Indonesia, both of the countries shall established cooperation about that. But if Hungarian wants to move to Spain so that there is no checking passport or visa.” said Prof. Fezer Tamas.

Beside gave presentation about consumer protection Prof. Tamas also gave lecture about product liability. In Europe, the system of product liability is based on the burden of proof. Prof. Tamas gave case to the students in example there is corporation designed product which caused serious health damage thus those corporation should liable for the damages. “This product liability law can be as our guidance for our legislative members to draft the specific law for the consumer protection.” said Dr. Siti Anisah, SH, M.Hum, one of the participants.
After the presentation, the Vice Director of Postgraduate Study, Faculty of Law, UII, Drs. Agus Triyanta, MA, PhD gave souvenir of appreciation to Prof. Tamas. “We already got amazing and excellent knowledge from him. We hope for collaboration between UII and University of Debrecen in future.” said Dr. Ni’matul Huda, SH, MHum, the Director of Postgraduate Study, Faculty of Law, UII during the interview session. Umar Haris S., SH, MH became the moderator of this session and more than 40 students followed the public lecture.

Sebagaimana direncanakan semua pembicara dapat hadir yaitu Dr. Siti Anisah, SH., MH. dari Fakultas Hukum UII Yogyakarta, Prof. Dr. Fezes Tamas, Ph.D. Wakil Dekan Fakultas Hukum Universitas Debrecen Hongaria, Prof. Jeffrey E Thomas, Ph.D. Guru Besar sekaligus Dekan Fakultas. Sebagai Keynote Speaker adalah Prof. Dr. Ridwan Khairandy, SH., M.Hum. mengawali pembicaraan dengan berbagai hal terkait dengan tuntutan hukum secara umum.

Seminar yang diawali tepat pukul 09.00 WIB di Mendut Ball Room tersebut dibuka oleh Wakil Rektor I Nandang Sutrisno, SH., LLM., M.Hum., Ph.D.. Dihadiri oleh 123 peserta dari berbagai universitas, seperti Universitas Pamulang Tangerang Selatan, Universitas Pontianak, Universitas Banghari Jambi, Universitas Mataram, Universitas Brawijaya serta universitas-universitas terkemuka di wilayah Yogyakarta.
Di Indonesia, konsep pengaturan permbuatan melawan hukum (PMH) dalam pasal 1365 KUH Perdata memunculkan penafsiran yang berbeda-beda diantara para ahli hukum perdata. Karena itu perlu dibandingkan dengan konsep pengaturan PMH di negara lain seperti Hongaria dan Amerika Serikat yang diatur dalam peraturan perundangan yang baru, sepesifik dan memberikan kepastian hukum. Dengan seminar internasional yang diselenggarakan oleh FH UII kali ini tentu akan dihasilkan studi komparatif konsep permbuatan melawan hukum menurut tigha sistem hukum yang berbeda yaitu menurut hukum perdata di Indonesia, Hongaria dan Amerika Serikat.

International Seminar “Tort Law in Various Legal Systems: Indonesia, Hungary, and USA”

Introduction:
Blacks Law Dictionary give definition of tort as a private or civil wrong or injury, including action for bad faith breach of contract, for which the court will provide a remedy in the form of an action for damages. In fact, there are various terminology of tort such as onrechtmatigedaad (Dutch Law), perbuatan melawan hukum or ‘unlawful act’ (Indonesian Law), and etc. Nowadays, the law of tort significantly has different concept and theories in each legal system.

In Indonesia, the concept of unlawful act or onrechtmatigedaad is regulated in article 1365 to 1380 Indonesian Civil Code (ICC/KUH Perdata). This concept was adopted from the Dutch Civil Code since its colonialism era. Article 1365 ICC stated that every illegitimate act, which causes damage to third parties, obliges the party at fault to pay the damage caused. Article 1366 ICC also stated that every person is responsible not only for the damage caused by his act, but also for those caused by his omission to act and by his imprudence.

Since 1919, both in the Netherland and in Indonesia, unlawful act defined in broader meaning, such as accordance with one of this behavior: violate the statute, contrary to other individual right, contrary to the parties obligation, contrary to morality norms, and contrary to prudence principle or the culture of the society. Many Indonesian Private Law scholars asked to reform the concept of tort to give certainty measures defining tort. This reaction becomes relevant if we compare with the Ducth Civil Law, now revised the concept of tort in separate book in their Civil Code. The United States of America also has different concept on tort law. This law has its origin in the British common law system. Most of United States tort law was developed by court decisions. Tort law in the United States exists to redress damages caused an individual by the conduct of another that falls below a standard of care defined by the civil courts.

The specific causes of actions comprising tort law in the United States are too numerous to list. It provides remedies for businesses that are harmed by the unfair and deceptive trade practices of a competitor.
