Immigration Policy Systems and Legal Security

Immigration has a very important role in maintaining state sovereignty. Through immigration, it is easy to know the traffic movement of people in the national border area. For this reason, an immigration system is needed to be supported by the latest infrastructure and information technology to facilitate data collection and data evaluation actions.

A good immigration system can guarantee data security protection and at the same time provide the information needed in an urgent immigration-related incident or case. The immigration cases referred to allegations of criminal acts of terrorism, drug trafficking, and human trafficking.

Not all countries have an up-to-date immigration systems. In Indonesia, for example, currently immigration data has shifted to digitalization, one of it, for example through the e-Hac application. This application was formed with the aim of obtaining real time information about the location of a person’s domestic travel in Indonesia, including international travel to Indonesia.

In addition to e-Hac, Indonesia also has an Immigration Management Information System which is usually better known as SIMKIM. Based on Article 1 of the Law of the Republic of Indonesia Number 6 of 2011 concerning Immigration, information and communication technology systems are used to collect, process, and present information to support operations, management and decision making in carrying out the Immigration Function. In practice, this system still lacks in integration between e-Hac and SIMKIM system.

In addition, the personal data security protection system also often leaks. This is because Indonesia does not yet have a comprehensive personal data protection law, including providing a strict monitoring system to avoid misuse of personal data.

Taking into account the issue related to guaranteeing the protection of personal data security in the immigration system, the Faculty of Law Universitas Islam Indonesia in collaboration with Youngsan University will hold an international seminar with the theme “Immigration policy system and legal security”. This seminar is fully funded by The Ministry ofEducation of the Republic of Korea and the National Research Foundation of Korea (NRF2020S1A5A2A03040483).
This seminar is expected to provide an overview of the implementation of the immigration system in Indonesia, the United States and South Korea. This seminar will present speakers, both academics and practitioners, so that they can provide a comparative explanation of the reality of immigration administration.
