Rethinking Komisi Nasional Disabilitas (KND): Kritik dan Idealita Lembaga Negara Independen

The National Commission for Disabilities (KND) was an independent non-structural state institution. This state institution was for formed to oversee the implementation of respect, protection, and fulfillment of the rights of persons with disabilities which have generally been regulated in Law No. 8 of 2016 concerning Persons with Disabilities. However, the existence of this state institution was very seriously questioned by people with disabilities community because this institution was considered to be under the authority of the government, controlled by the Ministry of Social Affair, and was considered not in line with the ideal conception of an independent state institution.

Abstrak
Komisi Nasional Disabilitas (KND) adalah lembaga negara non struktural yang bersifat independen.
Lembaga negara ini dibentuk untuk mengawal pelaksanaan penghormatan, perlindungan dan pemenuhan
hak-hak penyandang disabilitas yang secara umum telah diatur dalam Undang-Undang No. 8 Tahun 2016
tentang Penyandang Disabilitas. Namun demikian, keberadaan lembaga negara ini dipermasalahkan sangat
serius oleh komunitas penyandang disabilitas karena lembaga ini dinilai berada di bawah kekuasaan
pemerintahan, dikendalikan oleh Kementrian Sosial, dan dianggap tidak sejalan dengan konsepsi ideal
lembaga negara independen.
